MUSOLF PROPERTY MAINTENANCE – TERMS OF SERVICE

These Terms of Service (“Agreement”) govern all services provided by Musolf Property Maintenance (“Contractor”) to the customer (“Client”). By approving an estimate, proposal, invoice, scheduling service, or utilizing services provided by Musolf Property Maintenance, the Client agrees to the following terms and conditions.
1. SCOPE OF SERVICES
Services provided may include, but are not limited to:
• Lawn mowing and maintenance
• Landscaping services
• Mulch installation
• Fertilizer and weed control
• Aeration and overseeding
• Spring and fall cleanups
• Snow removal
• Irrigation services
• Property maintenance services
Specific services to be performed will be outlined within the approved estimate, proposal, invoice, or contract.
2. SCHEDULING, WEATHER & SERVICE TIMING
Musolf Property Maintenance will make reasonable efforts to complete services according to the agreed schedule. However, scheduling may be delayed, modified, or rescheduled due to:
• Weather conditions
• Saturated ground
• Frozen ground
• Heavy snowfall
• Lightning or severe storms
• Equipment breakdowns
• Material shortages
• Safety concerns
• Unforeseen operational delays
The Contractor reserves the right to determine when conditions are safe and appropriate for service completion.
Specific arrival times are not guaranteed unless agreed upon in writing.
Service routes are optimized daily based on:
• Weather
• Route efficiency
• Emergency services
• Equipment availability
3. PROPERTY ACCESS & CUSTOMER RESPONSIBILITIES
Client agrees to provide safe and reasonable access to the property during service hours.
The Client is responsible for:
• Unlocking gates if necessary
• Marking irrigation heads, invisible fences, septic systems, drain tile, private utilities, and hidden obstacles
• Removing toys, hoses, pet waste, furniture, and debris before service
• Providing accurate property boundaries and service areas
Additional charges may apply if:
• Property access is restricted
• Excessive cleanup is required
• Unsafe conditions delay service
Musolf Property Maintenance reserves the right to refuse or discontinue service due to:
• Unsafe working conditions
• Aggressive animals
• Hazardous materials
• Harassment or abusive behavior
• Repeated payment issues
• Excessive property neglect
4. LAWN, TURF & LANDSCAPE CONDITIONS
Musolf Property Maintenance is not responsible for damages caused by:
• Hidden or buried objects
• Unmarked irrigation systems or utilities
• Existing lawn disease, fungus, insects, or poor soil conditions
• Drought stress or weather-related turf damage
• Improper watering or customer neglect
• Existing drainage or erosion issues
Results from fertilization, weed control, overseeding, landscaping, and lawn restoration services may vary depending on:
• Weather
• Soil conditions
• Watering practices
• Existing turf health
• Sunlight exposure
No guarantee is made regarding:
• Complete weed elimination
• Seed germination rates
• Turf establishment
• Lawn thickness
• Color consistency
Minor turf stress, rutting, wheel marks, or surface impressions may occur during normal operations, especially during wet or thawing conditions.
5. IRRIGATION & UNDERGROUND UTILITIES
Client is solely responsible for properly marking and disclosing:
• Irrigation systems
• Drain tile
• Invisible fences
• Septic systems
• Underground wiring
• Landscape lighting
• Other concealed utilities or obstacles
Musolf Property Maintenance is not responsible for damage to unmarked, shallow, improperly installed, or undisclosed underground systems.
6. LANDSCAPING, MULCH & PLANT MATERIAL
Landscape renderings, sketches, and mulch bed layouts are for reference purposes only.
Final installation may vary slightly due to:
• Site conditions
• Existing grading
• Drainage
• Material availability
• Practical installation limitations
Natural products including:
• Mulch
• Rock
• Sod
• Trees
• Shrubs
• Plants
may vary in:
• Color
• Texture
• Moisture content
• Appearance
• Size
Exact color matches and material consistency cannot be guaranteed.
Unless specifically stated in writing, no warranty is provided on:
• Plants
• Trees
• Sod
• Seed
• Shrubs
• Transplanted materials
Client is responsible for watering and ongoing care after installation.
7. LAWN MOWING SERVICES
Weekly lawn mowing services may include:
• Mowing
• Trimming
• Edging
• Blowing off hard surfaces
Tall grass, neglected lawns, excessive clippings, or double cuts may result in additional service charges.
Additional fees may apply for:
• Pet waste cleanup
• Excessive toys or debris
• Restricted access
• Overgrown lawns requiring additional labor
8. FERTILIZER & WEED CONTROL SERVICES
Applications are performed according to manufacturer label requirements and industry standards.
Client agrees to:
• Keep children and pets off treated areas as directed
• Water applications when instructed
• Notify Contractor of concerns promptly
Temporary discoloration, stress, or sensitivity may occur depending on:
• Weather conditions
• Existing lawn health
• Drought stress
• Chemical sensitivity
No guarantee is made regarding complete weed elimination.
9. SNOW REMOVAL SERVICES
Snow removal services are performed according to the Client’s approved snow agreement.
Unless otherwise specified:
• Service is typically triggered at approximately 1.5 inches of snowfall
• Route order and timing are determined solely by Contractor
• Seasonal snowfall caps, if applicable, will be outlined in writing
Musolf Property Maintenance does not guarantee completely slip-free or ice-free surfaces.
Snow hauling, relocation, or removal is not included unless specifically stated.
Client acknowledges that slippery conditions may still exist after service completion.
10. ESTIMATES, PRICING & MATERIAL COSTS
All estimates are based on current labor, fuel, material, disposal, subcontractor, and operational costs.
Quotes are valid for 30 days unless otherwise stated.
Musolf Property Maintenance reserves the right to revise pricing if:
• Site conditions differ from original inspection
• Additional labor or materials are required
• Project scope changes
• Fuel or material costs significantly increase
• Hidden conditions are discovered
All measurements and material quantities are approximate and may vary slightly based on actual site conditions.
Quotes created using:
• Customer photos
• Satellite imagery
• Video walkthroughs
• Remote estimating tools
may be adjusted if actual conditions differ upon arrival.
11. PAYMENT TERMS
Unless otherwise stated:
• Payment is due within 30 days of invoice date
• Late payments may incur:
• $50 late fee
• 1.5% monthly interest (18% annually)
Larger projects may require deposits prior to scheduling.
Returned checks, failed ACH payments, declined cards, or chargebacks may result in:
• Additional fees
• Immediate balance due
• Suspension of services
Client agrees to pay all:
• Collection costs
• Attorney fees
• Court costs
• Interest charges
• Lien filing costs
associated with unpaid balances.
12. AUTOMATIC RENEWAL
Recurring lawn maintenance and snow removal agreements automatically renew each service season unless canceled in writing prior to the next service cycle.
Pricing and service terms may change annually.
13. SUBCONTRACTORS
Musolf Property Maintenance reserves the right to utilize qualified subcontractors when necessary to complete services efficiently and professionally.
14. PHOTOGRAPHY, DOCUMENTATION & GPS TRACKING
Client grants Musolf Property Maintenance permission to:
• Photograph properties
• Record videos
• Maintain service logs
• Utilize GPS route tracking
for:
• Documentation
• Quality control
• Marketing
• Social media
• Dispute resolution
• Collections support
No personal identifying information will be shared without consent.
15. ELECTRONIC COMMUNICATION & DIGITAL APPROVAL
Client consents to receiving:
• Invoices
• Scheduling updates
• Service notifications
• Weather delays
• Contract documents
electronically via:
• Text message
• Customer portal
• Phone communication
Electronic approvals, emailed approvals, online quote approvals, text confirmations, and digital signatures shall be considered legally binding acceptance of services and contract terms.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Musolf Property Maintenance’s total liability for any claim arising from services provided shall be limited to the total amount paid by Client for the specific service giving rise to the claim.
Under no circumstances shall Contractor be liable for:
• Indirect damages
• Consequential damages
• Loss of property value
• Lost profits
• Emotional distress
• Incidental damages
• Business interruption
17. INDEMNIFICATION
Client agrees to indemnify, defend, and hold harmless Musolf Property Maintenance, its owners, employees, subcontractors, and affiliates from any claims, liabilities, damages, injuries, or expenses arising from:
• Unsafe property conditions
• Failure to disclose hazards
• Unmarked utilities or irrigation systems
• Customer negligence
• Third-party actions related to the property
18. NO WARRANTY
Except where specifically stated in writing, Musolf Property Maintenance makes no warranties, express or implied, regarding:
• Lawn appearance
• Weed elimination
• Plant survival
• Turf recovery
• Drainage correction
• Snow or ice elimination
• Property value increases
All services are provided according to reasonable industry standards and best practices.
19. FORCE MAJEURE
Musolf Property Maintenance shall not be held liable for delays or inability to perform services due to events beyond reasonable control, including:
• Severe weather
• Natural disasters
• Fuel shortages
• Labor shortages
• Government restrictions
• Supplier shortages
• Equipment theft
• Catastrophic equipment failure
20. DISPUTE RESOLUTION
Both parties agree to first attempt good-faith resolution of disputes.
If disputes cannot be resolved informally, disputes may be resolved through binding arbitration in the State of Minnesota prior to litigation, except for unpaid invoices, collections matters, or mechanic’s lien enforcement.
Both parties waive the right to a jury trial to the fullest extent permitted by law.
21. MECHANIC’S LIEN RIGHTS
Client acknowledges that Musolf Property Maintenance reserves all rights available under Minnesota law regarding unpaid labor, services, and materials, including mechanic’s lien rights where applicable.
22. GOVERNING LAW
This Agreement shall be governed and interpreted according to the laws of the State of Minnesota.
23. SEVERABILITY
If any portion of this Agreement is determined unenforceable, the remaining provisions shall remain in full force and effect.
24. ENTIRE AGREEMENT
These Terms of Service, together with any approved estimate, proposal, invoice, or contract, constitute the entire agreement between the parties.
No verbal statements, representations, or promises shall modify this Agreement unless confirmed in writing.
25. ACCEPTANCE
Approval of any estimate, proposal, invoice, scheduled service, online quote, or digital communication constitutes acceptance of these Terms of Service.
